2. Services Description

Dream Beach Houses provides architectural design, consulting, and related services for residential beach properties. Our services may include, but are not limited to:

• Architectural concept development and design
• Construction documentation
• Interior design services
• Sustainable design consulting
• Project management
• 3D visualization and modeling

The specific services to be provided will be detailed in a separate Service Agreement between you and Dream Beach Houses.

3. User Accounts

Some portions of our services may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.1 Account Eligibility

To create an account, you must be at least 18 years old and provide accurate, complete, and current information. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.

3.2 Account Termination

We may terminate or suspend your account at any time for any reason, including, but not limited to, violation of these Terms. Upon termination, your right to use our services will immediately cease.

4. Intellectual Property Rights

All content, features, and functionality on our website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Dream Beach Houses or our licensors and are protected by copyright, trademark, and other intellectual property laws.

4.1 Design Ownership

Upon full payment for our services, clients will receive a license to use the designs for the specific project outlined in the Service Agreement. Dream Beach Houses retains ownership of all original designs, concepts, drawings, and other materials created during the design process. We reserve the right to use images of completed projects in our portfolio, marketing materials, and for professional recognition, unless otherwise specified in writing.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. This license does not include the right to:

• Modify, reproduce, or distribute any content from our website
• Use any data mining, robots, or similar data gathering methods
• Use our designs for any purpose other than the specific project for which they were created
• Resell or commercially exploit our content or designs

5. Payment Terms

Fees for our services will be outlined in your Service Agreement. Unless otherwise specified, payment terms are as follows:

• 50% deposit required before work begins
• Remaining balance due upon completion of design phase
• Additional fees may apply for changes requested after designs are approved
• Travel expenses, permit fees, and other third-party costs are not included in design fees and will be billed separately

Payments are accepted via credit card, bank transfer, or other methods specified in your Service Agreement. Late payments may incur additional fees and result in work stoppage.

6. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that our services will meet your requirements, be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy, reliability, completeness, or timeliness of any content, information, software, text, graphics, links, or communications provided on or through our website.

7. Limitation of Liability

IN NO EVENT SHALL DREAM BEACH HOUSES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our website
• Any content obtained from our website
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us during the six (6) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Dream Beach Houses, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

9.1 Arbitration

Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

9.2 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10. Termination

Either party may terminate the Service Agreement with written notice in the event of a material breach by the other party that remains uncured for 30 days. In the event of termination:

• You will be responsible for payment of all services performed up to the date of termination
• All licenses granted for unused designs will revert to Dream Beach Houses
• Any confidentiality obligations will survive termination

11. Miscellaneous

11.1 Force Majeure

Dream Beach Houses shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

11.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

11.3 Assignment

These Terms are not assignable, transferable, or sublicensable by you except with our prior written consent. We may assign, transfer, or delegate any of our rights and obligations without consent.

11.4 Entire Agreement

These Terms constitute the entire agreement between you and Dream Beach Houses regarding our services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
